The Party Wall etc. Act 1996 is designed to regulate the relationship between property owners when building work affects shared walls or boundaries. It sets out clear responsibilities for two main parties: the Building Owner and the Adjoining Owner.

Building Owner

This is the person who intends to carry out work that could affect a shared boundary or wall. The Building Owner is responsible for notifying the Adjoining Owner of the planned work and following the procedures set out in the Act. They are typically the party paying for any necessary work to the shared structure.

Adjoining Owner

The Adjoining Owner is the person whose property is next to the Building Owner’s and may be impacted by the proposed work. The Adjoining Owner has the right to be informed about the work and may raise concerns if the proposed works affect their property. While they cannot prevent the Building Owner from carrying out work, they can negotiate the terms of the work and ensure their property is protected.
